ClearPlayer — Terms of Service

These Terms of Service ("Terms") govern your use of the ClearPlayer application ("the App") provided by Clear Tech Limited ("we", "us", "our"). By downloading, installing or using the App you agree to these Terms in full. If you do not agree, do not use the App.

1. About the App

ClearPlayer is a media player application that allows users to access streaming content via a third-party portal or service provider. We do not host, own, control or distribute any of the content streamed through the App. All content is provided by your service provider and is subject to their own terms and conditions.

2. Eligibility

You must be at least 18 years of age to use this App. By using the App you confirm that you meet this requirement. If you are using the App to access content on behalf of a minor, you are responsible for ensuring appropriate supervision and access controls are in place.

3. Your Account and Portal Access

• You are responsible for maintaining the confidentiality of your login credentials.
• You must not share your account or portal access with anyone outside your household.
• We are not responsible for any unauthorised access to your account resulting from your failure to keep your credentials secure.
• Your access to content is governed by your agreement with your service provider, not with us.

4. Acceptable Use

You agree not to:

• Use the App to access, stream or distribute content you do not have the legal right to access
• Attempt to reverse engineer, decompile or modify the App
• Use the App for any unlawful purpose
• Attempt to circumvent any access controls, PIN locks or content restrictions built into the App
• Resell, sublicense or commercially exploit the App without our written permission

5. Content Responsibility

ClearPlayer is a media player only. We have no control over and take no responsibility for:

• The legality, accuracy or quality of any content accessed through a third-party portal
• The availability or uptime of any streaming service
• Any content that may be considered offensive, inappropriate or unlawful that is provided by a third-party service

If you have concerns about content available through your portal, you should contact your service provider directly.

6. Locked and Restricted Channels

The App includes a Channel Lock feature that allows certain channels to be protected by a PIN. It is your responsibility to set and maintain a PIN if you wish to restrict access to locked content, particularly in households with children. We accept no liability for access to restricted content where a PIN has not been set or has been shared.

7. Intellectual Property

The ClearPlayer app, its design, code and branding are the intellectual property of Clear Tech Limited. You may not copy, reproduce or redistribute any part of the App without our express written consent.

8. Updates and Changes

We may update the App from time to time to fix bugs, improve performance or add new features. We reserve the right to modify or discontinue the App or any part of it at any time without notice. We also reserve the right to update these Terms at any time. Continued use of the App after any changes constitutes acceptance of the updated Terms.

9. Disclaimer of Warranties

The App is provided "as is" without any warranty of any kind, express or implied. We do not warrant that the App will be uninterrupted, error-free or free of viruses or other harmful components. Your use of the App is at your sole risk.

10. Limitation of Liability

To the fullest extent permitted by law, Clear Tech Limited shall not be liable for any indirect, incidental, special, consequential or punitive damages arising from your use of or inability to use the App, including but not limited to loss of data, loss of revenue or loss of goodwill.

11. Termination

We reserve the right to suspend or terminate your access to the App at any time if we believe you have breached these Terms or are using the App in a manner that is unlawful or harmful.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
